Please read these terms carefully before booking or receiving services from Rough & Rugged Industries LLC. By scheduling a rental or service, or submitting your information, you agree to the terms outlined below.

Rough & Rugged Industries LLC

These Terms of Service govern the relationship between Rough & Rugged Industries LLC ("the Company") and any individual or entity ("the Client") who books, schedules, or receives equipment rental or earthworks services through our website or by direct contact. Our services include skid steer equipment rentals, land clearing, grading & site prep, and pad building across Palm Beach County, Broward County, and Martin County, Florida.

Definitions

  • "Company" refers to Rough & Rugged Industries LLC, based in Loxahatchee, Florida.
  • "Client" refers to any individual, contractor, property owner, or entity who requests, books, or receives equipment rental or earthworks services from the Company.
  • "Rental Services" refers to the daily or multi-day rental of skid steer equipment including the CAT 255, CAT 265, and CAT 275, along with available attachments.
  • "Earthwork Services" refers to professional land clearing, grading & site prep, and pad building services performed by the Company's crew on the Client's job site.
  • "Equipment" refers to any skid steer machine and/or attachment rented to the Client under these terms.

Service Scope

The Company will provide the services as confirmed during the booking process, including the equipment model, attachment selection, rental duration, or earthworks scope of work. Our two primary service categories are:

  • Equipment Rentals — Daily rentals of 2026 CAT 255, CAT 265, and CAT 275 skid steers with bucket or optional attachments (forks, Fecon, grapple, jackhammer, tree boom). Pay-4-get-3-free promotion applies when booking 7 consecutive days.
  • Earthwork Services — Land clearing, grading & site prep, and pad building. All earthwork jobs are quoted with a free, no-obligation estimate prior to any work beginning.

Any additional tasks requested during an active engagement that were not included in the original agreement may incur additional charges. The Client will be informed before any out-of-scope work is performed.

Booking & Scheduling

Services may be requested through our website contact form, by phone, or by text. The Company is available 24/7 and will respond promptly to all inquiries.

  • A team member will contact the Client to confirm equipment availability, rental dates, or earthworks scheduling.
  • All earthwork jobs begin with a free, no-obligation estimate. No work will begin without the Client's explicit agreement to the quoted scope and price.
  • The Company will make reasonable efforts to accommodate preferred dates but cannot guarantee specific availability during peak demand periods.
  • A confirmation will be sent once the booking is officially scheduled.

Pricing & Payment

All rental rates and earthwork estimates are provided to the Client prior to any booking or work beginning. No job starts without price confirmation.

Rental Rates (Daily)

  • CAT 255 — $400/day (bucket only)
  • CAT 265 — $500/day (bucket only)  |  CAT 265 with Fecon — $900/day
  • CAT 275 — $600/day (bucket only)
  • Pay 4 days, get 3 FREE — 7 days for the price of 4

Attachment Add-Ons

  • Forks — $75  |  Extended Forks (7 ft) — $25 extra  |  Grapple — $100
  • Jackhammer — $150  |  Tree Boom — $100
  • Earthwork jobs are quoted on a per-project basis. Free estimates are provided for all scope-of-work engagements.
  • Accepted payment methods include credit/debit card, Stripe, Square, PayPal, cash, or any method mutually agreed upon at the time of booking.
  • Payment terms will be specified at time of booking. Additional charges may apply for extended rental periods, site conditions that require additional equipment time, or last-minute requests.

Cancellations & Rescheduling

  • Clients must provide a minimum of 24 hours' notice for cancellations or rescheduling of equipment rentals.
  • Earthwork projects require a minimum of 48 hours' notice for cancellation or rescheduling, as crew and equipment logistics must be coordinated in advance.
  • Late cancellations may incur a fee to cover scheduling and logistics costs. The Client will be informed of any applicable fees at time of booking.
  • If the Company must cancel or reschedule due to weather, equipment issues, or other unforeseen circumstances, the Client will be notified promptly and an alternative date will be offered at no penalty.

Client Obligations

To ensure safe and effective service delivery, the Client agrees to:

  • Provide safe, unobstructed access to the property and all areas where work is to be performed or equipment will be operated.
  • Disclose any known underground utilities, irrigation lines, septic systems, or buried obstacles prior to earthwork services beginning.
  • Ensure the job site is clear of personnel, children, and animals during equipment operation.
  • Obtain all necessary permits or approvals required by local jurisdiction before earthwork begins, unless otherwise arranged with the Company.
  • Use rented equipment only for its intended purpose and within the operating parameters of the specific machine model rented.

The Company is not responsible for delays, incomplete work, or additional costs resulting from conditions not disclosed prior to service or from areas that are unsafe or inaccessible at the time of service.

Equipment Use & Safety

The Client accepts full responsibility for the safe and proper operation of any rented equipment during the rental period. The Client agrees to:

  • Operate the equipment only with a qualified, competent operator who understands the specific machine and its capabilities.
  • Not modify, alter, or attempt to repair the equipment at any time during the rental period.
  • Use the equipment only for lawful purposes and within the operating capacity specified for the rented model.
  • Return the equipment in the same condition it was received, normal wear and tear excepted.

The Company reserves the right to refuse service or retrieve equipment immediately if it is being operated in an unsafe, abusive, or non-permitted manner.

Damage & Liability

The Client is financially responsible for any damage to rented equipment that occurs during the rental period, beyond normal wear and tear.

  • Any damage to rented equipment must be reported to the Company immediately upon discovery.
  • The Client will be responsible for the cost of repairs or replacement of damaged components caused by misuse, neglect, or unauthorized use.
  • For earthwork services, any claim of property damage caused by Company operations must be reported within 48 hours of service completion. Claims reported after this window may not be eligible for consideration.
  • The Company is not liable for damage to undisclosed underground utilities, irrigation lines, or buried structures not identified by the Client prior to earthwork beginning.

Total liability for earthwork service disputes is limited to the documented value of the specific service rendered, unless otherwise required by applicable law.

Health & Safety

The safety of our crew and clients is a top priority. The Company reserves the right to pause, delay, or decline service if site conditions present a risk to personnel, including:

  • Presence of hazardous materials, biohazards, or undisclosed structural dangers on the job site.
  • Extreme weather conditions (flooding, lightning, severe wind) creating unsafe operating conditions.
  • Unauthorized individuals or animals present in active equipment operation zones.

If service is paused for safety reasons, the Client will be notified immediately and an alternative plan or timeline will be proposed at no penalty.

Satisfaction & Service Quality

Rough & Rugged Industries LLC stands behind the quality of every earthwork job. If you are not satisfied with the result of any service, we want to know immediately.

  • Service concerns must be reported within 48 hours of job completion.
  • The Company will assess the concern and, where valid, return to address or correct the issue at no additional cost to the Client.
  • This commitment covers work quality and scope completeness. It does not extend to changes in Client preference after work has been performed or to scope items not included in the original agreement.
  • Equipment rental satisfaction concerns must be raised before or at time of return. No credit or adjustment will be issued after equipment has been returned without prior communication.

Privacy & Confidentiality

All Client information, property details, and job site specifics are treated with strict confidentiality. Our full data practices — including how we handle SMS communications and personal data — are described in our Privacy Policy.

  • No Company personnel may photograph, video record, or share images of a Client's property without express permission.
  • Client contact details are never sold, rented, or shared for marketing purposes.
  • Before/after project photos used for portfolio or marketing purposes require explicit Client approval.

SMS & Communication Policy

By providing your telephone number and opting in through our website forms or direct communication, you agree to our SMS Policy.

  • Consent: By opting in, you explicitly consent to receive SMS text messages from Rough & Rugged Industries LLC regarding appointment confirmations, service inquiries, scheduling updates, and critical communication related to our services.
  • Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier plan.
  • Message Frequency: Message frequency varies based on your inquiry and ongoing support needs.
  • Opt-Out: You can opt-out of receiving SMS messages at any time. Simply reply STOP to any message you receive from us. After opting out, you will no longer receive text messages from us.
  • Help: If you need assistance or more information regarding our text messaging services, reply HELP to any message.
  • Privacy of Mobile Data: Your mobile information and explicit opt-in consent will never be shared, sold, or rented to third parties or affiliates for marketing or promotional purposes. Your privacy is our utmost priority.

Termination of Services

The Company reserves the right to decline, pause, or terminate services under the following circumstances:

  • Non-payment or failure to meet agreed payment terms.
  • Unsafe, inaccessible, or hazardous site conditions at time of service.
  • Misuse, abuse, or unauthorized use of rented equipment.
  • Harassment, threats, or abusive conduct directed toward Company personnel.

The Client may cancel services at any time by providing direct notice to the Company. Any work already performed or rental time already used will be invoiced accordingly.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions.

Any dispute arising from or related to these terms or the services provided shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached, disputes may be submitted to mediation or small claims court in Palm Beach County, Florida, unless otherwise required by applicable law.

Agreement

By requesting a quote, booking a rental, scheduling a service, or allowing work to begin on your property, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in full. These terms apply to all current and future engagements with Rough & Rugged Industries LLC.
